OFFICIAL RULES
ATS CLOSE-UP CHALLENGE
NO PURCHASE NECESSARY.
 

1. NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED.  No purchase or payment of any money or other consideration is necessary to enter or win.

2. SWEEPSTAKES PERIOD:  The ATS Close-Up Challenge (“Sweepstakes”) begins at 12:01 AM Central Standard Time (“CST”) on February 22, 2013, and ends at 11:59 PM Central Daylight Saving Time (“CDT”) on May 31, 2013 (“Sweepstakes Period”).

3. SPONSOR: Cadillac Division, General Motors LLC, 600 E. John Carpenter Freeway, Suite 150, Irving, Texas, 75062 .   The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook Inc., Twitter, Inc. or Instagram, LLC.  All inquiries, questions, comments, or complaints should be directed to Administrator or Sponsor.

4. ADMINISTRATOR:  All Terrain Productions, Inc., 2675 West Grand Avenue, Chicago, Illinois 60612-1144.

5. AGREEMENT TO THE OFFICIAL RULES:  By participating in the Sweepstakes, all entrants fully and unconditionally agree to and accept these Official Rules and the Sponsor’s and Administrator’s decisions which are final and binding in all matters related to the Sweepstakes.  Winning a prize (described below) is contingent upon fulfilling all requirements set forth herein.

6. PRIZES AND THE VALUE OF THE PRIZES.  Three (3) Grand Prizes: Each Grand Prize includes one (1) 2013 CADILLAC® ATS (manufacturer’s suggested retail price of no more than $37,945) (the “Grand Prize” or “Vehicle”).  If the Vehicle selected by Sponsor has a manufacturer’s suggested retail price of less than $37,945, the winner of the Grand Prize will NOT receive the difference in prize value. The winner of the Grand Prize is responsible for vehicle registration, license, title and insurance fees and for all costs associated with any available upgrade or option packages and any other expenses related to the acceptance and use of the Grand Prize not specified herein. The winner of the Grand Prize must take delivery of the Vehicle within 30 days of notice of availability from a Cadillac dealer near the residence of the winner of the Grand Prize, as chosen by winner, subject to Sponsor approval.  The winner of the Grand Prize must a have valid U.S. driver’s license and evidence of legally required insurance to take delivery. Neither Sponsor nor Administrator shall be responsible for delays in delivery of the Vehicle; delivery is subject to availability.  The Vehicle awarded may differ from any vehicle shown in promotional materials. The Vehicle’s color, options and equipment will be determined by Sponsor in its sole discretion.  Approximate Retail Value of Grand Prize is $37,945.  ARV of all prizes is $113,835.

7. HOW TO ENTER: 

    Basic Entry:  

A.  Online Method: Enter the Sweepstakes by visiting www.atscloseup.com (the “Website”) on or before 11:59 PM CDT on May 31, 2013, and click on the Sweepstakes banners, buttons or links to access the online entry form for the Sweepstakes.  Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible, including creating a profile with name, email address, and zip code.  Entrants will also be prompted to create a password.  Incomplete or inaccurate online entries are void.  By successfully transmitting a completed online entry form as directed, you will receive one (1) entry in the Sweepstakes.

B. Mail-In Method:  Enter the Sweepstakes by mailing a 3” by 5” note card on which you have hand-printed your full name, city, state, ZIP code, phone number with area-code, valid email address (optional) and the words “ATS CLOSE-UP CHALLENGE” with proper postage affixed to:  ATS Close-Up Challenge Basic Entry, c/o All Terrain Productions, 2675 West Grand Avenue, Chicago, Illinois 60612-1144.  MAIL ENTRIES MUST BE POSTMARKED BY May 31, 2013, AND RECEIVED BY June 9, 2013.  By successfully mailing in the entry card, your will receive one (1) entry in the Sweepstakes.

Limit one (1) basic entry per person, regardless of entry method. Additional entries beyond the specified limit will be void.

    Single Bonus Entry: 

A. Online Method:   Each entrant may receive one (1) additional entry by posting written or photo content on Facebook, Twitter or Instagram using one of the following hashtags: #ATSCloseUpAUS,  ATSCloseUpHOU or  ATSCloseUpDFW.  Posts must occur on or before 11:59 PM CDT on May 31, 2013.  Only entrants who use the Basic Entry Online Method may use the Single Bonus Entry Online Method. 

B. Mail-In Method:  Each entrant may receive one (1) additional entry by mailing a 3” by 5” note card on which you have hand-printed your full name, city, state, ZIP code, phone number with area-code, valid email address (optional) and the words “ATS CLOSE-UP CHALLENGE SINGLE BONUS” with proper postage affixed to:  ATS Close-Up Challenge Single Bonus Entry, c/o All Terrain Productions, 2675 West Grand Avenue, Chicago, Illinois 60612-1144.  MAIL ENTRIES MUST BE POSTMARKED BY May 31, 2013, AND RECEIVED BY June 9, 2013.  Limit one (1) 3” by 5” note card per outer envelope.

Limit ten (10) Single Bonus entries per person per day, regardless of entry method. Additional entries beyond the specified limit will be void.

    Fifty Bonus Entry: 

A. Online Method:    Each entrant may receive fifty (50) bonus entries by visiting a participating Street Team location and scanning the QR code on the decal affixed to the ATS vehicle. Upon scanning the QR code, consumer will be directed to a landing page which will ask the user to enter their email and upload a photo of the ATS with the QR code decal affixed to the car. Entries which do not include a photograph of the ATS with the QR code decal in the photograph will be disqualified.  Upon successful submission of the unique entry code, entrant will receive fifty (50) additional entries.   Entrants must successfully submit the unique entry code on or before 11:59 PM CDT on May 31, 2013. Only entrants who use the Basic Entry Online Method may use the Fifty Bonus Entry Online Method. Entrants will have the opportunity to complete the basic entry using the QR code method listed above. B. Mail-In Method:  Mail-In Method:  Obtain fifty (50) bonus entries by mailing a 3” by 5” note card on which you have hand-printed your full name, city, state, ZIP code, phone number with area-code, valid email address (optional) and the words “ATS CLOSE-UP CHALLENGE FIFTY BONUS ENTRIES” with proper postage affixed to:  ATS Close-Up Challenge 50 Bonus Entry, c/o All Terrain Productions, 2675 West Grand Avenue, Chicago, Illinois 60612-1144.  MAIL ENTRIES MUST BE POSTMARKED BY May 31, 2013, AND RECEIVED BY June 9, 2013.  Incomplete or inaccurate mail-in entries are void.

Limit one (1) Fifty Bonus entry per person per day, regardless of entry method. Additional entries beyond the specified limit will be void.

Online entrants to the Sweepstakes will be given the option to receive commercial e-mails (as determined in Sponsor’s sole discretion) from Sponsor (all information provided to Sponsor is subject to, and will be treated in a manner consistent with, the General Motors LLC Privacy Statement available at www.gm.com/privacy.  However, eligibility for the Sweepstakes is not dependent upon entrant’s consent to receive such e-mails and consenting to receive such e-mails will not impact entrant’s chances of winning.  

Mail-in Entries will not be acknowledged or returned.  Sponsor and Administrator assume no responsibility for lost, mutilated, late or misdirected entries.  Email addresses provided via the mail-in method will be used for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s provision of this information. 
 
Except where prohibited by law, by entering the Sweepstakes, entrant grants Sponsor and the Sweepstakes Entities (defined in Section 10 below), permission and a perpetual, worldwide, royalty free, license to use, reproduce, distribute, make derivative works, and/or display entrant’s submission in any and all media, now known or hereafter created.  Entries (i) must be the original and sole creation of the submitting entrant, and all right, title and interest including but not limited to the copyright in any Entry, must be owned solely by the submitting entrant;  (ii) may not have been submitted in any other competition, (iii) may not have been published; (iv) may not infringe upon any third party's rights, including but not limited to, copyright, patent or trademark, or rights of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light; (v) may not violate any law, rule or regulation; (vi) may not contain any virus, bugs, or other deleterious material; and (vii) may not contain inappropriate content, for example but not limited to, profanity, defamatory statements, words or symbols widely considered offensive to individuals of any certain race, ethnicity, religious, sexual orientation or socioeconomic groups, threats to any person, place, business, or group.  Each entrant warrants and represents that his/her Entry complies with all of those conditions. Any non-complying Entry will subject the entrant to disqualification in Administrator’s and Sponsor’s discretion.

8. TIMING OF DRAWINGS AND NOTIFICATION TO WINNERS.  Three Grand Prize winners will be determined at random drawings conducted at Administrator’s place of business (each a “Grand Prize Drawing”) on the following dates: April 10, 2013, May 10, 2013 and June 10, 2013 (each a “Drawing Date”) for a total of three (3) Grand Prize winners.
 
The non-winning eligible entries from one Grand Prize Drawing will carry over to subsequent Grand Prize Drawings.  Each potential Grand Prize Winner will be notified by phone or email (in the sole discretion of Administrator) within the two days following the date of the applicable Grand Prize Drawing (the “Prize Notification”). If any potential Grand Prize Winner does not respond to such Prize Notification within 24 hours of delivery of the notice for any reason, then disqualification and prize forfeiture will result and a second-chance drawing will occur at the time of the next scheduled drawing, or in the case of the June 10, 2013 Grand Prize Drawing, as soon as practical after the disqualification and prize forfeiture (each a “Second-Chance Drawing”).  Participants in any Second-Chance Drawing will consist of all eligible non-winning entries received as of the applicable Drawing.  If a Grand Prize is not timely claimed following any Second-Chance Drawing, then an additional drawing or drawings, as necessary, will be promptly conducted consistent with the procedures described in these Official Rules until the unclaimed Grand Prize has been awarded.   Each Grand Prize Winner may be required to execute, have notarized and return an affidavit of eligibility and release of liability and, unless prohibited by law, publicity, within seventy-two (72) hours of the time of issuance.  Failure to submit any identification required by Administrator or to return any required documents within the specified time period, non-compliance with these Official Rules or the return of the prize or Prize Notification as undeliverable may result in disqualification and prize forfeiture.

9. ODDS OF WINNING.  Odds of winning a Grand Prize will depend upon the number of eligible entries received as of the applicable Drawing Date from all entry methods.

10. ELIGIBILITY.  The Sweepstakes is open only to persons who, at the time of entry, are 21 years or older and a legal resident of the State of Texas.  All others are ineligible to participate in the Sweepstakes. In addition, any person who has previously won a prize in the Sweepstakes will not be eligible to win additional prizes in the Sweepstakes.  Employees, directors and officers and their immediate families (husbands, wives, brothers, sisters, parents and children and their spouses) and household members (whether or not related) of Sponsor, Administrator, Jack Morton Worldwide, Defakto Group, Defakto LLC, Martin Retail Group, Houston Area Cadillac Dealers, the Houston Area Cadillac Dealers Advertising Association, Metroplex Cadillac Dealers, the Metroplex Cadillac Dealers Advertising Association, Austin Area Cadillac Dealers, the Covert Cadillac Dealer Advertising Association, and each of their respective parents, subsidiaries and affiliates, and any and all other companies involved in the implementation and execution of the Sweepstakes or otherwise associated with the Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible to participate or win a prize.

11. WINNERS’ LIST.  For the names of the winners, please send a self-addressed and stamped envelope to “ATS Close-Up Challenge” Sweepstakes Winners, c/o All Terrain Productions, 2675 West Grand Avenue, Chicago, Illinois 60612-1144.  Requests for winners’ names must be received by August 15, 2013.  Allow four to six weeks for delivery of the list.

12. GENERAL PRIZE RESTRICTIONS.  The prizes are subject to availability and are subject to change.  The prizes may not be transferred, assigned, changed or redeemed for cash, except by the Sponsor, who reserves the right to substitute the prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion.  Any and all taxes (including but not limited to federal, state, local or income taxes) are the sole responsibility of the winner. Each Grand Prize winner will be required to provide his or her Social Security number and appropriate tax documentation for tax reporting purposes. Administrator will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of any prize.

13. GENERAL CONDITIONS AND RELEASE.  PLEASE READ THIS SECTION CAREFULLY AS THESE PROVISIONS AFFECT YOUR RIGHTS TO SEEK LEGAL REDRESS IN CONNECTION WITH THIS SWEEPSTAKES.  Except where prohibited by law, by participating in this Sweepstakes, each entrant (a) agrees to release General Motors LLC, Facebook Inc., Twitter, Inc. or Instagram, LLC, all Sweepstakes Entities (as defined above in Section 10 of these Official Rules), and each of their respective parents, affiliated companies, subsidiaries, directors, officers, agents, employees, managers, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives from any and all liability for any claims, costs, injuries, losses or damages of any kind that may occur, directly or indirectly, in whole or in part, by their participation in this Sweepstakes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of any prize or any travel or activity related to the receipt or use of any prize; (b) if selected as the Winner, consents to the use by Sponsor, Administrator and each of their respective designees of the winner’s name, hometown, photograph, voice, or other likenesses and prize information for promotion, advertising and marketing purposes in any media or format now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law, and upon request will provide written confirmation of such consent; and (c) ACKNOWLEDGES THAT NONE OF THE SWEEPSTAKES ENTITIES OR ANYONE ELSE HAS EITHER MADE, OR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR, ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO ANY PRIZE INCLUDING, BUT NOT LIMITED TO, ITS QUALITY OR AVAILABILITY.  Neither any of the Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical or electronic malfunctions, lost or delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail or e-mail, or any injury or damage to  an entrant’s or any other person’s computer, electronic equipment or other property related to or resulting from participation in this Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR WILL DISQUALIFY ANY SUCH ENTRANT, AND ADMINISTRATOR AND SPONSOR AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT OR INDIVIDUAL(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. No failure to enforce any term of these Official Rules shall constitute a waiver of that provision. If for any reason the Sweepstakes (or any portion thereof) is not capable of being executed as planned, or in the case of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes that in the opinion of Administrator, Sponsor or any of the applicable Sweepstakes Entities, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes (or any portion thereof), Administrator and any of the Sweepstakes Entities reserve the right in their sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes (or any portion thereof). In the event of any cancellation, termination or suspension, notice thereof will be posted at the Website and the determination of the prize winners will be made from among all eligible, non-suspect entries received as of the date of such termination, cancellation or suspension, as Administrator determines in its sole discretion. Entrants not complying with all rules are subject to disqualification.  In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of an established email account associated with the entry.  “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Employees, directors and officers and their immediate families (husbands, wives, brothers, sisters, parents and children and their spouses) and household members (whether or not related) of Sponsor, Administrator, Jack Morton Worldwide, Defakto Group, Defakto LLC, Martin Retail Group, Houston Area Cadillac Dealers, the Houston Area Cadillac Dealers Advertising Association, Metroplex Cadillac Dealers, the Metroplex Cadillac Dealers Advertising Association, Austin Area Cadillac Dealers, the Covert Cadillac Dealer Advertising Association, and each of their respective parents, subsidiaries and affiliates, and any and all other companies involved in the implementation and execution of the Sweepstakes or otherwise associated with the Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible to participate or win a prize.  

8. HOW TO ENTER:  Entrants must RSVP to the Kick-Off Party listed on the entrant’s invitation.  RSVP must be completed online at www.atscloseup.com prior to entering the Sweepstakes.  Entrants must also attend the Kick-Off Party listed in the invitation.  Only those individuals who attend one of the three Kick-Off Parties (occurring on March 7-9, 2013) will be entered into the Sweepstakes.  Failure to attend at least one of the three Kick-Off Parties will result in disqualification.

In addition to completing the online RSVP and attending the Kick-Off Party listed in the invitation, entrants must also complete the Sweepstakes registration process.  The registration process may be completed in one of two ways:

A.  Online Method:  Enter the Sweepstakes by visiting www.atscloseup.com (the “Website”) on or before 11:59 PM CDT on March 9, 2013, and click on the Sweepstakes banners, buttons or links to access the online entry form for the Sweepstakes.  Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible, including creating a profile with name, email address, and zip code.  Entrants will also be prompted to create a password.  Incomplete or inaccurate online entries are void.  By successfully transmitting a completed online entry form as directed, you will receive one (1) entry in the Sweepstakes.

Limit one (1) entry per person. Additional entries beyond the specified limit will be void.

Grand Prize Winner may be required to execute, have notarized and return an affidavit of eligibility and release of liability and, unless prohibited by law, publicity, within seventy-two (72) hours of the time of issuance.  Failure to submit any identification required by Administrator or to return any required documents within the specified time period, non-compliance with these Official Rules or the return of the prize or Prize Notification as undeliverable may result in disqualification and prize forfeiture.

10. ODDS OF WINNING.  Odds of winning the Grand Prize will depend upon the number of eligible entries received.  No more than 6,000 invitations will be extended.

11. WINNER’S LIST.  For the name of the winner, please send a self-addressed and stamped envelope to ATS Close-Up Kick-Off Challenge Winner, c/o All Terrain Productions, 2675 West Grand Avenue, Chicago, Illinois 60612-1144.  Requests for winner’s names must be received by April 30, 2013.  Allow four to six weeks for delivery of the list.

12. GENERAL PRIZE RESTRICTIONS.  The prize is subject to availability and is subject to change.   The prize may not be transferred, assigned, changed or redeemed for cash, except by the Sponsor, who reserves the right to substitute the prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion.  Any and all taxes (including but not limited to federal, state, local or income taxes) are the sole responsibility of the winner. Each Grand Prize winner will be required to provide his or her Social Security number and appropriate tax documentation for tax reporting purposes. Administrator will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of any prize.

13. GENERAL CONDITIONS AND RELEASE.  PLEASE READ THIS SECTION CAREFULLY AS THESE PROVISIONS AFFECT YOUR RIGHTS TO SEEK LEGAL REDRESS IN CONNECTION WITH THIS SWEEPSTAKES. Except where prohibited by law, by participating in this Sweepstakes, each entrant (a) agrees to release General Motors LLC, all Sweepstakes Entities (as defined above in Section 7 of these Official Rules), and each of their respective parents, affiliated companies, subsidiaries, directors, officers, agents, employees, managers, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives from any and all liability for any claims, costs, injuries, losses or damages of any kind that may occur, directly or indirectly, in whole or in part, by their participation in this Sweepstakes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of any prize or any travel or activity related to the receipt or use of any prize; (b) if selected as the Winner, consents to the use by Sponsor, Administrator and each of their respective designees of the winner’s name, hometown, photograph, voice, or other likenesses and prize information for promotion, advertising and marketing purposes in any media or format now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law, and upon request will provide written confirmation of such consent; and (c) ACKNOWLEDGES THAT NONE OF THE SWEEPSTAKES ENTITIES OR ANYONE ELSE HAS EITHER MADE, OR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR, ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO ANY PRIZE INCLUDING, BUT NOT LIMITED TO, ITS QUALITY OR AVAILABILITY.  Neither any of the Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical or electronic malfunctions, lost or delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail or e-mail, or any injury or damage to  an entrant’s or any other person’s computer, electronic equipment or other property related to or resulting from participation in this Sweepstakes. In the event of any cancellation, termination or suspension, notice thereof will be posted at the Website and the determination of the prize winner will be made from among all eligible, non-suspect entries received as of the date of such termination, cancellation or suspension, as Administrator determines in its sole discretion. Entrants not complying with all rules are subject to disqualification.  In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of an established email account associated with the entry.  “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Privacy

Your privacy is important to General Motors Company (GM), as is your trust in GM products and services. We want you to know that the information you share with us will be treated with care.

GM’s Privacy Statement for U.S. Consumers lets you know how we handle personally identifiable information you share with GM through gm.com and certain other GM Websites (e.g., GMGoodwrench.com or Chevrolet.com); at events; on Business Reply Cards (BRCs) and sweepstakes entries; and through our customer call centers. It also applies to information about you and your vehicle we obtain from GM affiliates, GM dealers, GM licensees for consumer merchandise, GM credit card bank partners, and other sources such as those that provide lists of potential vehicle purchasers, current owners, or potential cardholders. We have also included answers to frequently asked questions about features of GM vehicles that record and transmit data regarding vehicle functions. Some GM Websites have supplemental information on privacy, and others have their own privacy statements, which may be accessed at those Websites.

The information you share with us may be used by GM, our affiliates, our licensees, and dealers. It may be used by our suppliers exclusively to provide services for GM, and by our business partners to conduct joint marketing programs with GM. It may also be shared in connection with the sale, transfer or financing of a significant part of a GM business. We will not share your personal information with third parties other than these for their independent use without your permission.

Information Collection

GM may obtain information about you and your vehicle in a number of ways: For example, our Websites, Business Reply Cards, sweepstakes entries, test-drive incentive applications, surveys, vehicle sales records, and other public sources. While you may use GM’s Websites to learn about our products and services without disclosing any information about you or your vehicle, we may ask you to provide us with personal information including:

  • contact information (name, address, city, state and Zip Code, e-mail address, and telephone number)
  • vehicle information (vehicle identification number (VIN), make, model, model year, selling dealer, date of purchase or lease, etc.)
  • demographic information (age range, marital status, household composition, etc.)
  • non-credit-related marketing profile information (when you plan to purchase or lease; the vehicle in which you’re interested, etc.)
  • relationships you have with GM not related to your vehicle (i.e., GM Card or OnStar)

Business Reply Cards and sweepstakes entries you complete at an event or in response to a marketing mailing we send may also ask you to answer some of these same questions so we can tailor what we send to you to your specific interests.

In limited circumstances, you may be asked to provide GM with your social security number. For example, if you win a sweepstakes or receive compensation from GM, GM is required to include your social security number on government tax forms. GM maintains technical, administrative, and physical safeguards designed to protect the confidentiality of your social security number, and to prohibit the unlawful disclosure of and restrict access to this information.

In addition, our GM affiliates, GM dealers, GM merchandise licensees, and other sources such as those that provide lists of potential vehicle purchasers or current owners may give the information they have regarding you or your vehicle to us so that we may serve your needs better.

Uses

Information about you or your vehicle may be used to respond to your requests for product brochures, to customize and improve communication content, or for marketing or product research. It may also be used to provide you with helpful offers and information on GM products and services.

We may share information about you and your vehicle within GM, with our affiliates, and with our dealers. GM may also share personal information collected with our suppliers for the exclusive purpose of providing services for us (for example, mailing information in response to your request for a vehicle brochure) and with our business partners to conduct joint marketing programs with GM. It may also be shared in connection with the sale, transfer or financing of a significant part of a GM business. Information regarding your GM Card will not be shared with GM dealers.

GM will not share information about you or your vehicle with other third parties for their independent use without your permission.

You may choose to forward information from one of our Websites or e-mails to another person. E-mail addresses submitted to our E-card or other Forward to a Friend program will not be captured for later use in marketing unless that person consents.

We may disclose information about you or your vehicle as required by law, in conjunction with a government inquiry, or in litigation or dispute resolution.

Information Security

GM recognizes the importance of safeguarding consumer personal information in GM’s possession from theft, inappropriate use, or improper distribution. GM has security policies and procedures appropriate to the level of confidentiality of that data. Our suppliers have signed agreements to protect and use your data according to our requirements. It should, however, be recognized that no company can perfectly protect personal information.
